Returns and exchange

This English text is a translation provided for convenience. The atelier operates under the law of the Russian Federation, and in case of any discrepancy the Russian version of these Terms prevails.

1. General

These Terms set out how goods are returned and exchanged and how work and services of the atelier "FREYA" (Individual entrepreneur Maria Butakova, OGRNIP 323723200096292, INN 722514799193), website https://en.freyawedding.ru, may be cancelled.

They are drawn up in accordance with Law of the Russian Federation No. 2300-1 of 07.02.1992 "On Protection of Consumer Rights" and the Civil Code of the Russian Federation. Where the terms of your particular contract give you more rights than these Terms, the contract prevails. Rights established by law are not limited by these Terms.

There is no online payment on this site. A request from the site is not payment and creates no monetary obligation: it is an enquiry. All settlements are made only after a contract is signed.

2. Why the terms differ

We work in two different formats, and the law treats them differently. Find your case - it determines what you are entitled to ask for:

• Bespoke tailoring - the dress is created to your measurements and your sketch. This is the performance of work under a contract, not the purchase of a ready item (section 3).

• A ready garment or accessory - an item from stock, bought as it is (section 4).

3. Bespoke tailoring

3.1. Cancelling before the dress is finished

You may withdraw from the contract at any time before the finished dress is handed over. In that case you pay for the part of the work actually performed by the moment of withdrawal and reimburse the costs we have already incurred (article 32 of the Law "On Protection of Consumer Rights"). Such costs include, in particular, fabrics, lace and haberdashery purchased for your order, and the patterns built for it.

The amount of work performed is determined by the stage the order has reached (sketch, patterns, cutting, assembly, fittings, final finishing). We provide the calculation in writing, with supporting documents for the materials.

3.2. Returning a finished dress of proper quality

A bespoke dress cannot be exchanged or returned. It is created to your measurements and your sketch, has individually determined properties and can be used by you alone - such goods are excluded from the general rule on returns (clause 4 of article 26.1 of the Law "On Protection of Consumer Rights").

That is precisely why we hold two or three fittings: the fit, the length and the details are agreed with you during the work, not after it. Any remarks made at a fitting we address within the contract and at no extra charge.

3.3. If the work has defects

If the dress has defects, you may at your choice demand (article 29 of the Law "On Protection of Consumer Rights"):

• that the defects be remedied free of charge;

• a corresponding reduction of the price;

• that another item be made free of charge from material of the same kind;

• reimbursement of costs you incurred in remedying the defects yourself or through third parties.

If the defects are material or we have not remedied them within the agreed time, you may withdraw from the contract and demand full compensation for losses. Claims about defects are accepted during the warranty period, and where none is set, within a reasonable time up to two years from the day the dress was handed over.

We do not treat as a defect a change of fit caused by a change in your measurements after the final measuring. Such changes are addressed as separate alteration work - tell us in advance if you expect changes before the date.

4. Ready garments and accessories

Ordinary rules of sale apply to ready dresses from stock, accessories and jewellery.

4.1. Goods of proper quality

You may exchange a non-food item of proper quality for a similar one within 14 days, not counting the day of purchase. If there is no suitable item for exchange, you may return the item and receive your money back (article 25 of the Law "On Protection of Consumer Rights").

The conditions are: the item has not been used, its presentation, consumer properties, seals and factory labels are intact, and there is a document confirming the purchase. The absence of such a document does not deprive you of the right to rely on other evidence.

Underwear and hosiery cannot be exchanged or returned under this clause, being goods on the List approved by Resolution of the Government of the Russian Federation No. 2463 of 31.12.2020.

4.2. Goods of improper quality

If defects are found you may at your choice demand replacement, a proportionate reduction of the price, free remedy of the defects, or withdraw from the contract and demand the sum paid back (article 18 of the Law "On Protection of Consumer Rights"). We may carry out a quality check, and in a dispute about the cause of the defects, an examination at our own expense; you may be present while it is carried out.

5. How to contact us and how quickly we respond

Write to info@freyawedding.ru or call +7 904 463-36-66. In your message give: your name and contacts, the date and subject of the contract or purchase, the substance of your claim and, if it concerns defects, a description with photographs. We will confirm receipt and name the time for consideration.

Time limits for refunds:

• where there is no similar item for exchange - within 3 days from the day the item is returned;

• for the return of goods of improper quality - within 10 days from the day the claim is made.

Money is returned by the same means as the payment was made, unless you agree another means with us.

If we have not been able to agree, you may apply to Rospotrebnadzor or to a court. A pre-trial procedure is not compulsory for consumer disputes, but we ask you to write to us first: most questions are settled faster without proceedings.
